Terms of Service for Tape Quest

1. Scope

These terms of service apply to the use of the Tape Quest mobile app, offered by:

Referred to below as “we” or “the provider”.

By downloading and using Tape Quest, these terms of service apply within the scope of the applicable statutory provisions.

Mandatory statutory consumer rights are not affected by these terms of service.

2. Subject matter of the app

Tape Quest is a puzzle game for Android and iOS. Each puzzle consists of coloured tape strips that overlap one another. A strip can only be removed when it is free. Tapping a free strip peels it away; a blocked strip stays in place.

Tape Quest may contain the following functions, among others:

• a campaign with 1,000 levels of increasing difficulty
• Perfect Board for levels completed without a blocked move
• Perfect Chain for consecutive correct moves
• best times and the option to replay levels
• the Daily Quest, a daily puzzle with a worldwide leaderboard
• Endless, an open-ended mode with a leaderboard
• stars and achievements
• assistance functions within a level
• an optional daily reminder for the Daily Quest
• app settings, for example for sound and haptics
• the one-time in-app purchase that removes advertising

The exact range of functions may evolve through updates.

3. No user account

Using Tape Quest requires no registration and no sign-in. No user account is created.

Progress, best times and settings are stored on the device you use.

If you play Endless or the Daily Quest, the app registers automatically with our server so that your results can be placed in the leaderboards. You receive a randomly generated player ID and an automatically generated display name, for example “TapePlayer-4821”. The display name cannot be chosen or changed. Details are set out in our privacy policy.

4. Progress and local data

Your progress is stored locally. Uninstalling the app, clearing the app data, resetting the device or certain system changes may cause locally stored data to be lost.

There is no claim to restoration of lost progress, unless mandatory law provides otherwise.

Despite appropriate technical measures, it cannot be ruled out that technical errors lead to incorrect information about progress, best times or awards.

5. Daily Quest, Endless and the leaderboards

In addition to the campaign, Tape Quest offers the Daily Quest and the Endless mode. Both require an internet connection, because the puzzles and the results are provided and recorded by our server.

The Daily Quest provides one puzzle per calendar day. All players receive the same puzzle on the same date. Recorded for the leaderboard are in particular your solving time and whether the board was solved without a blocked move.

In Endless mode you keep solving until the run ends. Your best score is recorded for the leaderboard.

The leaderboards show your generated display name, your position and your result to other players. Only runs that meet the applicable requirements are counted.

Manipulating results or leaderboards is prohibited. We may remove entries that are obviously manipulated, technically faulty or created through misuse, and we may exclude a player ID from the leaderboards in the event of serious or repeated breaches.

We cannot guarantee that the Daily Quest or Endless can be reached or completed at all times. Maintenance work, technical faults, network problems or other circumstances may temporarily affect availability.

6. Stars and achievements

Tape Quest may award stars and achievements. They exist only within the app, have no monetary value, cannot be paid out, exchanged or transferred, and can be changed or discontinued through updates.

Stars can be earned in the game and, optionally, by watching a video ad. Watching a video ad is always voluntary.

7. Assistance functions

Tape Quest may offer assistance functions within a level, for example indicating a possible next move.

Using such assistance may mean that a level no longer counts as a Perfect Board. The level may still count as completed.

There is no claim to the permanent availability of a particular assistance function, unless expressly agreed otherwise.

8. Advertising

Tape Quest can be used free of charge and is financed through advertising. Full-screen ads (interstitials) may be shown occasionally.

Ads are not shown during a puzzle, but between selected completed levels.

In addition, the app may offer optional video ads that you can watch to earn Daily Stars. Watching them is voluntary; declining them does not restrict the rest of the game. The one-time purchase “Remove ads” removes the interstitials.

The respective advertisers are responsible for the content of the ads shown. Details about data processing in connection with advertising can be found in our privacy policy.

9. In-app purchase “Remove ads”

Tape Quest offers a one-time in-app purchase that permanently removes advertising.

It is not a subscription. No recurring payments become due.

The purchase removes advertising only. It does not unlock or change any game content, levels or game functions.

10. Purchase handling via Google Play and the Apple App Store

Depending on the device you use, the purchase is made via Google Play or the Apple App Store.

The specific price is shown in the respective purchase dialog. The price displayed there at the time of purchase is the one that applies.

Payment processing, payment methods and the technical administration of the purchase are handled by Google Play or the Apple App Store. The terms of Google or Apple may apply to the purchase in addition.

We do not receive complete credit card or bank details.

11. Restoring purchases

Tape Quest provides a function to restore a purchase you have already made, insofar as this is technically possible via Google Play or the Apple App Store.

This requires in particular that Google or Apple can still assign the purchase to the account you used. No further payment is required to restore a non-consumable purchase that is still valid.

12. Refunds and statutory rights

The applicable statutory provisions and the respective procedures of Google Play or the Apple App Store apply to refunds of a purchase processed through those platforms.

Statutory warranty, withdrawal and consumer rights are not restricted by these terms of service.

If a purchase is cancelled, refunded or otherwise declared invalid by Google or Apple, the associated ad-free entitlement may be deactivated.

13. Availability

We strive to operate Tape Quest reliably. However, availability at all times, without interruption and free of errors, cannot be guaranteed.

In particular, the following events may lead to restrictions:

• maintenance work
• disruptions at hosting or platform providers
• unavailability of the server that provides the Daily Quest, Endless and the leaderboards
• problems with Google Play or the Apple App Store
• internet or network disruptions
• necessary security measures
• app updates
• changes to operating systems or platform requirements

Temporary technical disruptions do not give rise to further claims, unless mandatory law provides otherwise.

14. Permitted use

Tape Quest may only be used within the scope of applicable law and these terms of service.

The following are prohibited in particular:

• circumventing technical protection measures
• manipulating the ad-free entitlement or other entitlements
• forging or manipulating proof of purchase
• manipulating progress, best times, stars or achievements
• manipulating leaderboard results or submitting results that were not achieved in normal play
• automated requests, bots or scripts against our server endpoints
• unauthorised access to the server, the database or other players' entries
• deliberately overloading or disrupting the technical infrastructure
• using the app for unlawful purposes

Acts that are mandatorily permitted by law remain unaffected.

15. Intellectual property

Tape Quest, including in particular the software, the game mechanic in its specific implementation, the level design, the visual design, texts, graphics, user interface, logos and other content created by us, is protected within the scope of the applicable statutory provisions.

By installing the app you receive a simple, personal, non-exclusive and non-transferable right to use it for private purposes.

No ownership rights or other intellectual property rights in Tape Quest are transferred as a result. Rights in third-party components and services remain with the respective rights holders.

16. Changes and updates

We may develop Tape Quest further, fix errors and add or change functions. Changes may become necessary in particular due to security requirements, legal requirements, changes to platform requirements or technical development.

We may adapt these terms of service insofar as this is necessary and reasonable for you. The current version is published on this page.

17. Liability

We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health.

In cases of slight negligence we are liable only for the breach of a material contractual obligation, that is, an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely, and in that case limited to the foreseeable damage typical for this type of contract.

Liability under the German Product Liability Act remains unaffected.

18. Ending your use

You can stop using Tape Quest at any time by uninstalling the app.

Uninstalling does not automatically delete entries already stored in the leaderboards. You can request their deletion at any time; our privacy policy explains how.

Purchases you have already made remain assigned to your account within the terms of Google Play or the Apple App Store.

19. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are acting as a consumer, this choice of law applies only insofar as it does not deprive you of the protection afforded by mandatory provisions of the law of the state in which you have your habitual residence.

20. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

22. Final provisions

Should any provision of these terms of service be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provisions then take the place of the invalid provision.
